At the University of West Florida, a license to use the University's marks may be obtained by entering into a License Agreement.
The licensee is required to submit, at its' own expense, a sample of the product as it would be produced for sale. UWF will approve or disapprove the sample within thirty (30) days after the sample is received by UWF. The sample is deemed accepted if UWF signs the License Agreement and the product is listed as a Licensed Good on Exhibit "B" of the Agreement. All samples submitted must bear the name or symbol of the person or entities seeking UWF approval.
The License Agreement is a three-year agreement between the manufacturers of emblematic goods and the University of West Florida.
The Agreement calls for the payment of a non-refundable advance fee (usually in the amount of $100) at the time the agreement is executed. This fee is an advance against future royalties.
The licensee agrees to pay the university a royalty of six and one half percent (6.5%) of the net sales of all licensed articles sold during the term of the agreement.
The licensee is required to provide quarterly reports to the university.
The licensee is required to produce general and products liability insurance and to furnish a Certificate of Insurance to the UWF evidencing the coverage.
Any University of West Florida representation in combination with other words or graphics confusingly similar to those of UWF legal trademarks is prohibited.
Notes
Manufacturers of merchandise which is not for the purpose of resale, such as items to be used by the UWF Athletic Department, are exempt from paying an advance fee and royalties.
