New Title IX regulations

On May 6, 2020, the Department of Education amended the regulations implementing Title IX of the Education Amendment of 1972. Title IX is a federal law that prohibits discrimination on the basis of sex in any education program or activity that is federally funded. The final regulations specify how recipients of Federal financial assistance covered by Title IX must respond to allegations of sexual harassment. The final regulations require institutions respond promptly and supportively to persons alleged to be victimized by sexual harassment, resolve allegations of sexual harassment promptly and accurately under a fair grievance process that provides due process protections to alleged victims and alleged perpetrators of sexual harassment, and effectively implement remedies for victims.

Key change areas include: what constitutes notice to the university that sexual harassment has occurred; who can be considered a complainant of sexual harassment; jurisdiction of alleged sexual harassment incidents; training requirements for individuals in the university’s Title IX process; cross-examination during a live hearing process; providing advisors to complainants and respondents of sexual harassment during cross-examination; and the standard of evidence that may be used by institutions. There are many moving and interlinking parts to the new regulations. The final regulations are effective August 14, 2020.

As we navigate what is needed to comply with the new regulations, multiple campus partners are working together. This includes the Office of Equal Opportunity and Title IX, General Counsel, Dean of Students office, Academic Affairs, Human Resources, UWF Police, and Institutional Communications, just to name a few. This collaborative approach will ensure we are thorough in our compliance efforts. While the university makes the necessary changes to the University’s Title IX processes and procedures, questions regarding the actions steps being taken can be sent to Aurora Osborn, Interim Title IX Coordinator.
